Η Ευρωπαϊκή Επιτροπή αποφάσισε να αποστείλει αιτιολογημένη γνώμη στην Ελλάδα, λόγω μη συμμόρφωσης με την απόφαση-πλαίσιο για το ευρωπαϊκό ένταλμα σύλληψης και τις διαδικασίες παράδοσης μεταξύ των κρατών μελών.

Το ευρωπαϊκό ένταλμα σύλληψης (ΕΕΣ) αποτελεί απλουστευμένη διασυνοριακή δικαστική διαδικασία παράδοσης καταζητούμενου προσώπου προς τον σκοπό της άσκησης ποινικής δίωξης ή της εκτέλεσης ποινής ή μέτρου στερητικού της ελευθερίας. Το ένταλμα, που ισχύει από την 1η Ιανουαρίου 2004, αντικατέστησε τις χρονοβόρες διαδικασίες έκδοσης που ίσχυαν μεταξύ των κρατών μελών της ΕΕ. Η Επιτροπή απέστειλε για πρώτη φορά προειδοποιητική επιστολή στην Ελλάδα τον Ιούνιο του 2021. Η Επιτροπή κατέληξε στο συμπέρασμα ότι η Ελλάδα δεν είχε μεταφέρει ορθά τις διατάξεις σχετικά με τους προαιρετικούς λόγους άρνησης και τις εγγυήσεις που πρέπει να παρέχονται από τη δικαστική αρχή έκδοσης και τη διέλευση. Η Ελλάδα έχει πλέον προθεσμία δύο μηνών για να απαντήσει και να λάβει τα αναγκαία μέτρα για την αντιμετώπιση των ελλείψεων που επισημάνθηκαν από την Επιτροπή. Η Επιτροπή, εάν δεν λάβει ικανοποιητική απάντηση, μπορεί να αποφασίσει να παραπέμψει την Ελλάδα στο Δικαστήριο της ΕΕ.
